Si el auto de calificación es de sobreseimiento, después de notificado a las partes, se remite el expediente al juez de segunda instancia en grado de consulta. El juez puede confirmar el auto o revocarlo; si lo confirma se archiva el expediente; si lo revoca debe llamar a responder a los responsables por los cargos que les aparecen en el expediente, ante un Consejo de Guerra. En este último caso, se devuelve el expediente al juez sustanciador, para que prosiga la causa.
