Continuación de l a investigación suspensión del juzgamiento. Desde que se presente la petición de recusación o desde que se manifieste impedido el funcionario, hasta que se resuelva definitivamente el incidente, se suspenderá, el pro ceso si estuviere en oportunidad para formular la acusación o en la etapa de juzgamiento, pero si estuviere e n investigación, c ontinuará la actua ción. En caso de suspensión del proceso no precede el hábeas corpus.
