°. Modifícase el artículo 4° del Decreto 4301 de 2008, el cual quedará así: “Artículo 4°. Arancel Extracuota : A las importaciones que superen los Contingentes Anuales establecidos en el artículo 1° de este decreto, se les aplicará el Arancel Extracuota establecido en el numeral 4 del artículo 3° del Decreto 430 de 2004, tal como se indica a continuación: Las subpartidas arancelarias 1005.90.11.00, 1005.90.12.00 y 1201.00.90.00, correspondientes a maíz amarillo, maíz blanco y fríjol soya, respectivamente, pagarán el mayor arancel entre 5% y el arancel total resultante de aplicar el Sistema Andino de Franja de Precios (SAFP).

Parágrafo

Lo dispuesto en las normas del Mecanismo Público de Administración de Contingente (MAC) no se podrá aplicar de una manera incompatible con los tratados de libre comercio vigente para Colombia”.
