Las circunstancias personales que disminuyan o excluyan la responsabilidad, no se tienen en cuenta sino respecto del autor o cómplice en quien concurran.

Tampoco se tienen en cuenta aquellas cuyo efecto sea agravar la sanción, a menos que fueren conocidas por el partícipe; pero en este último puede disminuirse tal agravación hasta en una sexta parte.
