Terminado el sumario sobre un delito de que deba conocer el encargado del detall, lo pasará al Fiscal para que rinda su exposición dentro de veinticuatro horas; obtenida ésta, remitirá lo actuado al Comandante de la Unidad, quien previo el dictamen del Auditor, que deberá rendirse dentro de veinticuatro horas, resolverá si el delito es de la competencia del encargado del detall, en cuyo caso le devolverá el sumario para que aprehenda el conocimiento o para que practique la ampliación de las diligencias señalando al efecto las que deban practicarse.
