Art. 23. El Pagador que omita un descuento o retiro, o lo haga defectuosamente, será personalmente responsable de los perjuicios que sufra el Monte-pío; pero si la omisión depende de la falta de aviso que debió dar un Jefe de Oficina o de descuido en el presupuesto de un habilitado, éstos serán respectivamente los responsables. En cualquiera de estos casos el Tesorero hará inmediatamente el cobro, ya sea ocurriendo al superior del responsable, ya al Poder Judicial.
