Pérdida o destruída una obra inédita, total o parcialmente, se estará a lo siguiente:

Si la obra se pierde o destruye en poder del autor o de sus causahabientes y por negligencia de ellos, pagarán al editor la suma que le hubiere correspondido en caso de edición;

Pérdida o destruída la obra en poder del editor y por culpa suya, indemnizará al autor o a su causahabiente todo perjuicio sufrido y les pagará la suma que les hubiere correspondido como regalía en caso de edición.
