º La investigación de antecedentes penales prevista en el artículo 12 del Decreto 848 de 1990, se adelantará por intermedio de la Dirección de la Policía Judicial e Investigación (Dijin) de la Policía Nacional. Si de la investigación no resultare la existencia de antecedentes penales, el Ministerio de Defensa Nacional podrá autorizar el trámite de los documentos para la obtención de la licencia de funcionamiento, señalada en el artículo 18 del Decreto 848 de 1990.
