° La utilidad imajinaria o la comision no se considerarán incluidas en el seguro de mercaderías, sino cuando se hubiere estipulado espresamente en la póliza: en este caso, si se hubiese declarado el valor asegurable sin espresar qué proporcion de tal valor representa la utilidad imajinaria, o si no se hubiere declarado valor asegurable se considerará asegurado como utilidad imajinaria el diez por ciento del valor declarado o del valor asegurable (art. 1.°) segun el caso: lo propio sucede con respecto a la comision, con la modificacion, sin embargo, de sustituir al diez por ciento por el dos por ciento.
