Cuando un individuo ya condenado haya de ser juzgado nuevamente en virtud de algún recurso judicial, por el mismo delito que motivó la primera condenación, la prescripción se computará teniendo en cuenta la pena que deba infligirse conforme a la segunda sentencia, si fuere más leve que la primera.
