El desistimiento de la instancia por el abandono de ésta restituye las cosas a su estado anterior, quedando a salvo el derecho de la parte para volver a proponer el juicio por una sola vez. Los otros desistimientos producen también el efecto de retrotraer las cosas al estado que tenían cuando se interpuso el recurso de que se desiste, pero no podrá la misma parte interponer nuevamente el mismo recurso o incidente sobre que versó el desistimiento. El desistimiento de la acción produce los efectos de "cosa juzgada".
