Siempre que una empresa o patrono a cuyo servicio haya trabajadores afiliados a una organización sindical, de hecho o con personería jurídica reconocida, se vieren en el caso de afrontar un cierre definitivo o temporal o una reducción de su personal, una vez fijado el aviso previsto en el artículo 10 de la Ley 78 de 1919, deberán dirigirse a la correspondiente Oficina Seccional o Auxiliar de Trabajo, en demanda de autorización para llevar a cabo el licénciamiento definitivo o transitorio de trabajadores que gocen del fuero sindical establecido en el artículo 18 del Decreto legislativo número 2350 de 1944, o para verificar la reducción cuando en ella hayan de comprenderse trabajadores que gocen del mismo fuero.
