El acto de trámite que niegue la práctica de pruebas solicitadas en su oportunidad por el Encartado, será susceptible del recurso de apelación para ante el inmediato superior de quien la deniegue, en el efecto suspensivo, salvo que en el mismo se ordene la práctica de algunas, caso en el cual se concederá en el devolutivo. En las actuaciones de única instancia, sólo procederá el recurso de reposición.
