El acto administrativo que ordena la convocatoria a consulta popular o que la niegue quedará sujeto a la revisión de la legalidad y constitucionalidad que ejercerá el correspondiente tribunal administrativo. Para este efecto, a más tardar al día siguiente a la expedición del acto, el Concejo lo enviará al tribunal y si no lo hiciere éste aprehenderá inmediatamente y de oficio su conocimiento.
