El desistimiento de la parte agraviada extinguirá la acción y la condena penales en las infracciones que no pudieren investigarse sino en virtud de querella o petición de parte. El desistimiento de que trata el inciso anterior no producirá efectos respecto del acusado que no lo acepte.
