El miembro del Cuerpo de Custodia y Vigilancia Penitenciaria Nacional, que haya sido retirado, podrá ser reintegrado al servicio activo:
Cuando se siguiere proceso penal y recayere sobre él sentencia absolutoria o sobreseimiento definitivo;
Al vencimiento del término de retiro temporal ordenado por el Tribunal de Honor o disciplinario.
