º. En desarrollo del artículo 15 del Código del Menor, todo menor tiene derecho a ser protegido contra el uso de sustancias que producen dependencia. En consecuencia, ningún menor, mujer embarazada o en período de lactancia podrá portar o consumir estupefacientes o sustancias psicotrópicas.

Parágrafo

En virtud del artículo 13 de la Constitución Política, lo dispuesto en este artículo se aplicará igualmente a las personas incapaces de acuerdo con el Código Civil.
