El que se apropie en su provecho o en el de un tercero, de una cosa mueble ajena que se la ha confiado o entregado por un título no traslaticio de dominio, incurre en prisión de seis meses a tres años y multa de diez y mil pesos.

Si no hubiere apropiación sino uso indebido de la cosa con perjuicio de tercero, la pena se reducirá hasta en la mitad.
