Art. 44. Loa nombramientos de Jueces Superiores, de Circuito y Ejecutores se harán en la forma prevenida en el artículo 1.° de la Ley 39 de 1898 .

Parágafo. Los suplentes de los Jueces no necesitan acreditar los requisitos de que trata el artículo 2.° de la citada ley para posesionarse y ejercer las funciones de Juez.
