Garantía Para Demandar

Garantía para demandar. El término mínimo por el cual deberá suscribirse la garantía para demandar de que trata el artículo 867 del Estatuto Tributario será de un (1) año, contado a partir de la interposición de la demanda de nulidad y restablecimiento del derecho. Antes de vencerse el término, la garantía deberá renovarse sucesivamente por períodos mínimos de un año, hasta la culminación del respectivo proceso. La garantía para demandar no será exigible cuando las sanciones se impongan en resolución independiente. El monto del descuento a que se refiere el

Parágrafo

del artículo 867 del Estatuto Tributario, será equivalente a la sumatoria de las primas canceladas tanto por la garantía inicial, como por sus renovaciones.
