Si el fallo resuelve que el pago se haga en la forma autorizada por el artículo 423 del Código Civil y el demandado no hace la consignación dentro del término que se le señale, que no puede pasar de diez días, el Juez decreta el embargo y remate de bienes del deudor en la cantidad necesaria para que se obtenga el capital fijado.
