Articulo 34 . Insubsistencia del docente no escalafonado. Cuando el docente no sea escalafonado podrá ser declarado insubsistente discrecionalmente a menos que se trate de alguno de los casos de excepción previstos en el Decreto 85 de 1980, en cuyo caso la insubsistencia sólo podrá decretarse por las causales mencionadas en dicha norma, sin ,arreglo a la tabla de progresividad ni al procedimiento de que trata este Decreto, pero en todo caso la autoridad no-minadora deberá solicitar y analizar los descargos respectivos y expedir una resolución motivada.
