Vencido el término de que trata el artículo anterior, y cuando las diligencias han sido adelantadas por el funcionario de instrucción, debe pasarlas al Juez, quien llegado el caso, puede ordenar la práctica de nuevas pruebas, las cuales deben llevarse a cabo dentro del término de cinco días.
