Cuando en la respectiva unidad operativa Fuerza Aérea o Armada Nacional falten Oficiales o Suboficiales de los grados y antigüedad necesarios para integrar el Tribunal, el Juez de primera instancia debe dirigirse al Ministro de Guerra para que le envié la lista del personal en servicio active, de esos grados, de otra u otras reparticiones, y con ellos forma o completa, según el case, la lista de acuerdo con la cual debe llevarse a cabo el sorteo, en la forma establecida en el artículo 59 de este Código.
