Auto de proceder. El Juez dictará auto de proceder cuando, encontrándose en desacuerdo con la solicitud fiscal de sobreseimiento definitivo o de archivo del sumario, considere que hay mérito para llamar a juicio al sindicado, y cuando la acusación no comprenda delitos conexos, por los cuales deba responder el sindicado, caso en el cual lo llamará a juicio por la totalidad de los delitos.
