En los casos de incendio deberá el funcionario de instrucción inquirir si el fuego ha tenido origen en la casa o establecimiento de algún comerciante.

Si así fuere y no se descubriere el autor desde el primer momento, hará tomar los libros y papeles del comerciante, averiguará si la casa o establecimiento incendiado estaba o no asegurado, el monto del seguro, y el valor del edificio, de las mercancías y de los muebles objeto del seguro, que existían en la casa o establecimiento al momento del Incendio.
