Los inventores que en otros países hayan obtenido privilegio para su descubrimiento, y que lo soliciten para este en la República, podrán obtener la respectiva patente de invención con tal que dichos descubrimientos no sean del dominio público, y caducaran en cuanto se compruebe que fueron expedidos en perjuicio de terceros, lo cual será juzgado y decidido por el Poder Judicial.
