Sin perjuicio de las demás exigencias legales y reglamentarias, el otorgamiento de licencias de funcionamiento a los programas académicos que pretendan ofrecer las instituciones a que se refiere el artículo anterior, requiere la previa aprobación del estudio de factibilidad para dichos programas por parte del ICFES y de sus estatutos por parte del Ministerio de Educación Nacional, previo concepto del ICFES.
