Constituye presunción legal de que un individuo de mala conducta anterior debidamente comprobada, consistente en actos lesivos del derecho de propiedad, es responsable del delito de robo o hurto, el hecho de encontrarse en su poder la cosa robada o hurtada, si no explica satisfactoriamente el modo legítimo de adquisición y no comprueba plenamente los hechos en que funda tal explicación, y siempre que, por otra parte, esté plenamente comprobado el cuerpo del delito.
