TEXTO CORRESPONDIENTE A

LEGISLACIÓN ANTERIOR

Artículo 2.2.2.9.2.3. Ingreso del expediente al Despacho. El secretario ingresará el expediente al Despacho cuando el juez deba proferir alguna providencia por fuera de audiencia y todos los términos comunes hayan vencido en relación con todas las partes.

El secretario se abstendrá de ingresar el expediente al Despacho mientras esté corriendo un término, salvo en los siguientes casos:

1.

Cuando todos los interesados en el término hayan renunciado a él expresamente.

2.

Cuando la solicitud se relacione con el mismo término.

3.

Cuando, previa consulta verbal con el juez, la solicitud requiera de un trámite urgente.

En estos dos últimos casos, el término se suspenderá y se reanudará a partir del día siguiente al de la notificación de la providencia que dé respuesta a la solicitud.
