Los militares colombianos y los extranjeros, al servicio del Ejército Nacional, que cometieren alguno de los delitos contemplados en este Título en presencia del enemigo, extranjero o interno o hallándose el país en estado de guerra, internacional o interna, serán castigados con la mayor pena correspondiente, además de las que fueren aplicables por delitos especiales contra la soberanía y la seguridad exterior o interior del Estado, o por cualquier otro delito.
