Las sanciones previstas en el artículo anterior serán impuestas por la Superintendencia de Sociedades, aunque se trate de compañías no sometidas a su vigilancia, o por la Superintendencia Bancaria, respecto de sociedades controladas por ésta.

Estas sanciones serán impuestas de oficio o por denuncia de cualquier persona.
