Son Oficiales de Reserva:

1.° Los Oficiales procedentes del Ejército activo que hayan hecho un buen retiro.

2.° Los aspirantes a Oficiales de Reserva que llenen las condiciones establecidas en el Reglamento de Reclutamiento y servicio de Reemplazo a los cuales el Poder ejecutivo les conferirá el grado.

3.° Los individuos, que sin estar en servicio activo, tengan despacho militar expedido por autoridad competente.
