El que omite, rehuse o retarde la ejecución de algún acto a que legalmente esté obligado o que en ejercicio de sus funciones, o so pretexto de ejercerlas, sin motivo legítimo, emplee o haga emplear atropello o violencias contra cualquier persona, incurre en .arresto de dos meses a dos años
