El Ministerio de Trabajo y Seguridad Social, por intermedio de sus funcionarios competentes, y en cada caso, determinará cuándo una empresa o empleador ha efectuado un despido colectivo de trabajadores, sin sujeción a las normas del presente capítulo. Los trabajadores afectados por la decisión del empleador se encontrarán en la situación prevista por el artículo 140 del Código Sustantivo del Trabajo.
