Los honorarios del apoderado del demandante serán fijados mediante auto por el Juez y equivaldrán al tres (3%) por ciento del avalúo catastral del inmueble, suma que en ningún caso podrá ser inferior a un (1) salario mínimo legal mensual vigente. Los honorarios del perito si lo hubiere, serán fijados de igual manera teniendo en cuenta la calidad de la experticia y el avalúo catastral, determinándose con un máximo del 1% de este avalúo y un mínimo del 50% de un salario mínimo legal mensual vigente.
