A la prenda minera le son aplicables las disposiciones legales que regulan la prenda agraria, en cuanto sean compatibles con su naturaleza. Dicha prenda prescribe en diez años, contados desde la fecha de su inscripción. La caución hipotecaria que garantice préstamos mineros, prescriben la forma y términos señalados en la ley civil.
