Competencia Para Establecer La Capacidad

Competencia para establecer la capacidad. Será competente para establecer la capacidad de un atractivo turístico la autoridad a cargo de la regulación de dicho atractivo, así:

Parágrafo 1

Cuando sobre un mismo atractivo turístico sean competentes dos o más entidades, estas deberán fijar la capacidad del atractivo conjuntamente.

Parágrafo 2

Cuando se trate de atractivos turísticos ubicados en las áreas protegidas del Sistema Nacional de Áreas Protegidas (SINAP), la capacidad de carga será fijada por la respectiva autoridad ambiental, atendiendo también los lineamientos establecidos por el Ministerio de Ambiente y Desarrolle Sostenible.
