Sobre la propiedad intelectual derivada de investigaciones realizadas con muestras de un biobanco. Se podrán configurar derechos de propiedad intelectual e industrial sobre las invenciones o los datos generados por el investigador a partir del material cedido por el biobanco. Tanto el material como los datos suministrados por el biobanco no son susceptibles de ser protegidos por vía de propiedad intelectual. El biobanco podrá requerir ser informado de los desarrollos que devengan en propiedad intelectual con el fin de garantizar los derechos de los donantes, previo a su tramitación y bajo condiciones de confidencialidad que garanticen el apropiado tratamiento de la información protegible.
