Art. 79. Los funcionarios de instrucción actuarán siempre con su respectivo Secretario; pueden nombrar uno ad hoc por impedimento de aquél. La diligencia de posesión bastará que la firmen el funcionario y el nombrado Secretario.

Parágrafo

El individuo nombrado Secretario ad hoc sólo podrá excusarse de este servicio por las causales siguientes: 1ª Impedimento Físico; 2ª Enfermedad grave de padre, madre, esposa ó hijo, ó muerte de los mismos, ocurrida en los ocho días anteriores; 3ª No haber cumplido veintiún años ó tener más de sesenta; Y en general, todas aquellas causas legales que se reconocen como suficientes para excusarse de servir un destino de aceptación forzosa.
