La solicitud debe ir acompañada de concepto favorable del Consejo Disciplinario del establecimiento donde el reo se encuentre. El Juez la pasará al respectivo Agente del Ministerio público que en un término de tres días opinará sobre la conveniencia o inconveniencia del otorgamiento de la gracia. Cuando la sentencia de primera instancia hubiere sido dictada por un consejo de guerra verbal, la solicitud se hará a quien convocó ese consejo.
