Cuando las firmas no hayan sido reconocidas o debidamente abonadas, o cuando de las declaraciones resulte que la cubierta no está cerrada, marcada y sellada como en el acto del otorgamiento, el testamento no presta mérito alguno mientras no se declare su validez en juicio ordinario con audiencia del heredero abintestato.
