Art. 40. Cada uno de estos grandes ramos de legislación se divide en materias, según los asuntos de que se trate. La calificación minuciosa de las materias se hará por el gobierno, oyendo previamente el parecer del Consejo de Estado.

Al hacer dicha clasificación se determinara cuales materias pueden unirse para arreglarlas en una misma ley o Código, y cuales deben ser previamente organizadas por leyes especiales.
