Art. 78. La corte suprema y los tribunales superiores, por auto para mejorar proveer, acordado por los magistrados cuando el negocio haya pasado a su estudio para sentencia, pueden disponer, si lo estiman conveniente, que se practique en nuevo avaluó, por peritos que la misma corte o tribunal en su caso, nombraran.
