En los casos de los delitos de calumnia e injuria no se procederá sino por acción privada del ofendido. Si éste falleciere, antes de haber formulado la acción, o durante el juicio, o si los delitos afectaren la memoria de una persona difunta, la acción podrá ser intentada o continuada en su ejercicio, por el cónyuge, los ascendientes, los descendientes o los hermanos.
