No obstante lo dispuesto en el artículo anterior, si el sindicado no fuere hallado en el lugar del proceso, para hacerse la citación de que trata el artículo 48 de la Ley 51 de 1898 , se le citará por edicto, que se fijará en el local de la ofician de instrucción por diez días y se publicará en uno e los periódicos del mismo lugar, si los hubiere, y si no compareciere, se le nombrará defensor que lo represente en la práctica de las respectivas diligencias.
