Si en los casos previstos en losArtículos precedentes, la persona ofendida hubiere sido causa determinante e injusta del hecho, la pena se disminuye de la tercera a las dos terceras partes; y si las ofensas son recíprocas, el Juez puede declarar exentas de pena a las partes.

No es punible por injuria el que se ha inducido a cometerla por violencias personales que se le infieran.
