Cuando en un mismo sumario aparezcan varios sindicados, el sobreseimiento a favor de alguno o algunos, no será motivo para detener el curso legal de la causa contra quienes se haya procedido, la que debe adelantarse hasta ser definitivamente fallada.

Si el superior revoca el sobreseimiento, el juicio se tramitara como si desde un principio se hubiere iniciado separadamente.
