No se decretará la suspensión de los Agentes, Oficiales o Suboficiales de Policía, ni se les reducirá a prisión preventiva sino después de dictado auto de proceder, cuando a juicio del Juez el hecho de que se les sindica haya tenido lugar en ejercicio de las funciones propias de sus cargos y no hayan procedido con exceso.
