Al testigo que citado no comparezca a declarar, o no permanezca en su casa de habitación a la hora señalada, sin causa que justifique su no asistencia, se le impondrá por el juez o funcionario de Instrucción una multa hasta de cincuenta pesos, convertible en arresto, a razón de un día por cada dos pesos, quedando siempre en el deber de rendir su declaración.
